The Supreme Court is getting ready to have another hearing on the Second Amendment regarding our rights to bear arms.
Someone posted this in the comments section of the article I was reading. If they are true, just about all gun laws are unconstitutional.

Re: Guns Rights
Yes, Federal gun laws are unconstitutional. So someone says the classic and ubiquitous; What about owning a tank ?
The 50 states have relatively uniform laws to control firearms. Outlawing a (active) tank would not be a problem.
In terms of jurisdiction Amend 2 was written as a handcuff on the central government to have anything to do with arms in the several states. Period.
The US Government has however complete control (jurisdiction) over DC, US Territories and Indian reservations. Period.
As has been said before, the US Government started "incorporating" the Bill of Rights in 1921 with Gitlow V NY. Although a 1st amendment case the barn door was opened for Federal Courts to siphon power from the states. To date there is no where Congress, the courts or the Executive (through the hundreds of regulatory administrations) will not go.
