The law can be an absurd pile of crap in some cases.

The cops cannot prove anything so why investigate...let alone pull him out of the car for impeding an investigation. :x

The car WASN'T moving.
If the car wasn't supposed to be there, it would be towed or impounded, not the driver arrested.

The cops didn't have probable cause to search the vehicle, let alone pull him out to search it.

They are screwed.
If you are in the drivers seat of a parked vehicle smelling like alcohol then its probable cause for a DUI.
I could be mistaken, but I am pretty sure they can ticket you for sleeping in the back if you have the keys.

I remember (barely) a night many years ago. I passed out in a friend's car, they drove to another party and left me to me sleep in the car. Good thing nobody spotted me. :D I couldn't imagine being charged with a DUI in someone else's car, no keys, doors locked...
