Should be interesting how it plays out
"Shouting fire in a crowded theater" is a popular analogy for speech or actions whose principal purpose is to create panic, and in particular for speech or actions which may for that reason be thought to be outside the scope of free speech protections. The phrase is a paraphrasing of a dictum, or non-binding statement, from Justice Oliver Wendell Holmes, Jr.'s opinion in the United States Supreme Court case Schenck v. United States in 1919, which held that the defendant's speech in opposition to the draft during World War I was not protected free speech under the First Amendment of the United States Constitution. The case was later partially overturned by Brandenburg v. Ohio in 1969, which limited the scope of banned speech to that which would be directed to and likely to incite imminent lawless action (e.g. a riot)

As far as I can tell, there are no charges of "insurrection " or "sedition" in the Special Counsel's charges related to the 2020 election. Is that correct? I'm thinking, Jack Smith's case would be the same if -- instead of invading the US Capitol and attacking police officers -- the protesters has consisted of 100 grandmothers who chanted quietly and didn't cross the barricades.

OK, I'm being a bit snide here. I know there are people who think that the January 6, 2021, events were no big deal. I happen to disagree. But my point is that Smith's indictment is focused on things that happened after the election and before January 6, i.e., things that then-President Trump did to try to stay in power: using the Justice Department for his own ends, putting pressure on then VP Pence to act outside of his constitutional role, putting pressure on state officials to change their certified election results, and spreading incorrect information about voting machines and improper ballots.

yeah, he's not being charged with sedation, attempting to overthrow the government on the 6th. It's broader than that. It's more like a swindle, trying to influence the election results. He is it seems accused of taking advantage of the disorder of the 6th.
. The indictment alleges that Trump and co-conspirators “exploited” the January 6, 2021, attack on the US Capitol by continuing efforts to convince members of Congress to delay the certification of the election that day.

What's going to happen next, that is other than the Georgia indictment. He is going to go after Pence in such a way that he is going to be charged with intimidating a witness. The angles to this thing are unbelievable.

Did the delay actually happen? I think the First Amendment allows for individuals to SAY anything they want, but if no one listens, then what????? Like going up to your friend who just got a parking ticket and you tell him not to pay the fine. They gonna arrest you for that?

It's all smoke and mirrors with the hope that people won't vote for Trump. Seems to me the potential charges against Biden are far more damaging to him and dangerous for the Country.

Ron DeSantis canned his campaign manager, he has also laid off 40% of his staff. Trump is facing all these issues but DeSantis can't take advantage of it, his campaign has come off the rails.

I don't think anyone is attempting to deprive Trump of the right to say "I won the 2020 election." He's doing that on a regular basis to this day. The indictment is addressing various actions Trump took to overturn the results of the election -- i.e., overturning the official results that he lost the popular vote in various states (e.g., GA, AZ, PA, WI, MI, NV). He hasn't been indicted for saying he won. Rather, it's the concrete actions such as pressure on local officials to overturn the results and putting forward slates of electors in these states who would vote for him (to replace the electors selected through official processes who voted for Biden).

Just spoke to a guy from Phoenix and the conversation steered toward politics. He believes that the left's unabashed hatred towards Trump is because they're afraid of him. He also thinks that a lot of the lefties are afraid of being exposed (re: Epstein). They're doing everything in their power to portray him as the bad man in order to get rid of him. Even if it means making shit up.

Couldn't disagree.

On one hand it's funny when people believe politics is is real. On the other hand, it's so depressing.
