Just curious what that was about, I don't really follow it, so the issue is in play at the state level, interesting angle

Actually it's at the Federal Court level.Donn Beach wrote: ↑Tue Jun 27, 2023 2:50 pmJust curious what that was about, I don't really follow it, so the issue is in play at the state level, interesting angle

It's at the federal level. That is why the determination in CA is going to affect the law in Washington....they are both in District 9.
The determination for the Illinois law is going to be decided in New Orleans in District 5.
Yes, they are state laws, but they have gone up the court system to the Federal Districts.
I'd also assume they have appeals in the specific states as well, but this will be decided at the Federal Court level.

I understand, I'm saying the effort to create law has moved from the federal leve, congress l to the state. The constitutionality needs to be testedWalla Walla Dawg II wrote: ↑Tue Jun 27, 2023 4:42 pmIt's at the federal level. Yes, the more wack-a-doodle the state seems to have gotten, the more the constitutionality needs to be tested. The problem is that the state courts don't have the balls to tell their governors that the law is unjust.

I don't think so.Donn Beach wrote: ↑Tue Jun 27, 2023 11:15 pmthe republican viewpoint has always been built on states rights, it wasn't wack-a-doodle when it came to abortion was it
I truly believe that if it isn't written in the Bill of Rights, then it's up to the states to decide.
Abortion, if a state population votes to ban it, then it should be ban in that state. Please note that I said states population and not governing body.
I am all in on the 2nd Amendment, but I'm also against a Federal Conceal-Carry permit; all because it steps on a states rights to decide if they want other people from other states with the ability to conceal their weapon.

There is more to the constitution than the first ten amendments. It's up to the states to pass laws, it's up to the supreme court to decide if they are constitutional or not.
